In this case, part of the arbitration proceedings took place in London but English courts declined jurisdiction. The dispute was between the Dubai Bank and Payment Merchant Services Inc that is a VISA processing company based in Texas USA. Dispute was submitted to arbitration purely on paper. So, no seat as such or no hearing. Secondly, appeal was submitted to VISA International Board of Directors in California that was an internal appeal procedure of Paymentech. Appeal was heard in London with international board meeting and the appeal was dismissed. Dubai Bank appealed in English High Court and the Court declines jurisdiction to hear the appeal. Court felt that even though appeal proceedings were conducted in London, closest connection to the arbitration was California.
