Dean v Stout (2005) EWHC 3315 (Ch)

D’s estranged husband became bankrupt. The order for possession and sale of the matrimonial home was made. D lived there with her children and she had contributed to the purchase price of the property and had made mortgage payments.

Held: The fact that the family would be evicted from their home did not amount to exceptional circumstances within the meaning of the Insolvency Act 1986 s.335A.
