Chokar v Chokar [1984] Family Law 269

Mr. Chokar was the sole legal owner of the family home. He held the property on trust for his wife and himself. Mrs. Chokar went to the hospital to give birth. Meanwhile, he secretly sold the house and when she returned she found that the locks were changed.

Held: Her intention was to return home; her furniture at the property showed an intention of actual occupation and this was only a temporary absence.
